The Division Bench of Justice Rajiv Sahai Endlaw and Justice Manoj Kumar Ohri has noted that: ‘…in view of the unprecedented prevailing circumstances and the matter of decongesting the prisons with which the Supreme Court was concerned in the writ petition aforesaid, and without creating any precedent, a case for modifying the bail orders passed either by this Court or by any court subordinate to it, on or before 7th April, 2020, thereby doing away with the condition of furnishing surety bond and instead, allowing the under-trial prisoners to be released on their furnishing personal bond to the satisfaction of Superintendant of Jail, is made out.’ The present matter was taken up suo moto by the court after the Registrar received a communication of the directions of the High Powered Committee from the Delhi State Legal Services Authority. The High Powered Committee was constituted, pursuant to the order of the Supreme Court in Re: Contagion of COVID19 virus in prisons, to look into the matter of decongesting the prisons. On April 7, the said Committee had passed the following directions: UTPs in whose favour, the bail orders were passed by different courts may have been incapacitated to furnish bail bonds and surety bonds, owing to the outbreak of Covid-19 and scant working of the courts, thus, the bail orders qua such UTPs are required to be modified, to the extent that they may be released on furnishing “Personal Bond”, with rest of the conditions if any, imposed remaining unaltered. Thus, Committee is of the opinion that a Judicial order would be required from Hon’ble High Court of Delhi, for modification of such bail orders passed either by High Court of Delhi or any court subordinate to it, on or before today’s date i.e. 07.04.2020, thereby modifying/doing away with the condition of furnishing surety bond and instead allowing such UTPs to be released on their furnishing personal bond to the satisfaction of Superintendant of Jail. Appearing for the Delhi Government, Standing Counsel Rahul Mehra informed the court that implementing the recommendations of the High Powered Committee would be in consonance with the orders of the Supreme Court in Moti Ram Vs. State of Madhya Pradesh, and R.D. Upadyay Vs. State of Andhra Pradesh, wherein the grant of bail was permitted on furnishing the personal bond only. Mr Mehra also informed the court that there is no list of cases in which inspite of bail order, the under-trial prisoners continue to languish in prison because of failure to furnish surety bond. While upholding the recommendations of the High Powered Committee, the court clarified that this order should not be construed as changing any other condition if any imposed in the bail orders aforesaid passed by this Court or by any Court subordinate to it. Therefore, the court has asked for release of UTPs, who were granted bail by different courts on or before April 7 but are still languishing in jails due to incapacity to furnish sureties, upon furnishing a personal bond to the satisfaction of the Superintendent of Jail. ‘We are confident that the D.G. We will do everything we can to systematically and permanently EDUCATE and build in all age groups and at all levels to meet the demands that lie ahead. First of all, preserving and improving the physical and mental health of our guests. We have no other choice. Idealistic? In these dumb times, I thought: Isn’t it time for tourism workers in Croatia and in the world to encourage themselves first, then everyone else around them with a manifesto that will first mentally and then actively focus on what and for what – they live. The goal is to preserve one of the ten jobs that tourism generates today at the global level and to improve all activities and phenomena that tourism will further develop and improve in a way that brings both tangible and intangible benefits. In such tourism, the spiritual takes precedence over the material in a way that spiritually generates the material, opening the way for added value to tourist products and services. In order to achieve this, it is necessary to change the focus and the way of acting by adopting NEW VALUES. Tourism that makes us all BETTER in the end with its overall performance! Therefore, TOURISM is THE NEW AGE and TRANSFORMATIVE TOURISM. That is, tourism that does not separate or oppose but connects both in good and less good times cities, regions and countries by offering integrated and innovative tourism products and services. Conceptual word ”manifest”Binds to the word”proclamation”. Instead of tourism excel managers, let’s create leaders of relationships that base added value on EMPATHY, EMOTION and ENERGY. It implies that we have something to say. As a rule, something – fateful. It is the right time to offer tourism, or more precisely tourism workers, new VALUES and thus a new HOPE. Top up, upgrade! Thus, the importance of the role of the manifesto is confirmed, for example, by modern companies that know how to reach for the manifesto as an incentive tool for their employees to guide them in understanding what they do and then deliver what they do as consistently as possible. Can you do better? Any such consumption of space ultimately undermines and then disintegrates the space, and thus the people who inhabit that space or make it attractive in a broader sense to visitors.
